Drone use by Massachusetts State Police

Background

In late 2021 and the spring of 2022, the ACLU of Massachusetts filed a series of public records requests to understand how the Massachusetts State Police (MSP) uses drones.

On December 14, 2021, we asked for communications, contracts, purchase agreements, invoices, records pertaining to the use of drones, and manuals, policies, and procedures. On May 10, 2022, we asked for records pertaining to any warrants obtained by MSP to use drones to conduct surveillance. On May 24, 2022, we asked for more records pertaining to the use of drones, including additional logs, notes, police reports, incident reports, intelligence reports, and other records that showed who operated or used drones, how and when, and for what reasons. Department of Unemployment Assistance: Use of Facial Recognition and ID.me

Background

On August 26, 2021, The ACLU of Massachusetts filed a public records request with the Massachusetts Department of Unemployment Assistance (DUA) seeking information about the use of automation and artificial intelligence tools in the unemployment insurance identity verification process, including facial recognition technology. The request also sought specific information about the relationship between DUA and the company ID.me, which obtained a state contract to perform identify verification for the agency during the Covid-19 pandemic.

Plymouth County Sheriff’s Department Records

Background

On August 12, 2021, the ACLU of Massachusetts and Prisoners’ Legal Services filed a public records request with the Plymouth County Sheriff’s Department seeking policies, procedures, guidelines, and instructions pertaining to language interpretation and translation services for individuals with Limited English Proficiency (“LEP”), attorney access, and COVID-19 related protocols.

On November 22, 2021, the ACLU of Massachusetts filed another public records request with the Plymouth County Sheriff’s Department seeking policies, procedures, guidelines, and instructions pertaining to Plymouth County Correctional Facility’s formal grievance system, policies regarding the facility’s U visa certification process, the number of immigration detention units, and the number of immigration detainees.

CBP Title 42 Expulsions

Background

On March 13, 2021, the ACLU of Massachusetts submitted a FOIA request to U.S. Customs and Border Protection asking for records concerning an anti-immigrant policy that expels asylum seekers from the southern United States border under the auspices of a public health measure. These records were sought in order to help the public understand how the public health authority of 42 U.S.C. § 265—whose 128 words were last modified in 1944—came to be used to override U.S. immigration laws and expel asylum seekers at the border without any legal process or screening. CBP’s response includes a July 28, 2021 guidance memorandum calling for “enhanced efforts to apply T42” and “the use of lateral flights” in light of the migrant “surge” in the Rio Grande Valley.

Suspect Technologies and the Plymouth PD

Background

In July 2018, the ACLU of Massachusetts filed requests with dozens of police departments to learn about how they use face surveillance technology. The Plymouth Police Department provided hundreds of emails in response to that request. The emails contain a years long correspondence between a billionaire-backed face surveillance start-up called “Suspect Technologies” and representatives for the Plymouth Police Department.
